Terms of Service

The short version: your first month costs $1. After that, your subscription renews automatically at $15/month until you cancel. You can cancel anytime in one click; cancellation takes effect at the end of the period you've already paid for. MuscleUp is a fitness app, not medical advice — listen to your body and check with a doctor if you're unsure.
1. Who we are
MuscleUp ("MuscleUp", "we", "us") provides an adaptive workout-training application available on the web and on Android. These Terms govern your use of the MuscleUp app, website and related services (the "Service"). 2. Accepting these Terms
By creating an account, starting a subscription or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service. You must be at least 16 years old (or the age of digital consent where you live, if higher) to use MuscleUp.
3. Your subscription
Introductory price
New subscribers pay $1 for the first month. The introductory price is available once per person.
Automatic renewal
At the end of the first month, your subscription renews automatically at $15 per month, and continues to renew each month at the then-current price until you cancel. The renewal price is shown clearly at checkout before you pay. Prices may be shown in, or converted to, your local currency, and may include applicable taxes (such as VAT) depending on where you live.
Price changes
If we ever change the monthly price, we'll tell you in advance by email or in the app, and the new price will only apply from your next billing period after the notice. You can cancel before it takes effect.
Payment processing
Payments are processed by PayPal, which receives your payment details directly; PayPal's own terms also apply to the transaction. We don't store your card or bank details. [Merchant-of-record wording to be confirmed before launch.]
4. Cancelling
You can cancel anytime, in one click, from your account page (or from your PayPal account, under automatic payments). Cancellation takes effect at the end of your current billing period — you keep full access until then and you won't be charged again. If you cancel during your $1 first month, you won't be charged the $15 renewal.
5. Refunds
Except where required by law, payments already made are non-refundable, and we don't provide refunds or credits for partial billing periods. Nothing in these Terms limits your statutory rights — including any right to cancel a distance transaction and receive a refund under consumer-protection law that applies to you (for example, the Israeli Consumer Protection Law, or EU/UK consumer law if you live there). If you believe you're entitled to a refund, contact support@muscleup.app and we'll handle it promptly and fairly.
6. Health and safety
MuscleUp is not medical advice. The programs, coach responses and food feedback are general fitness information, not a diagnosis or treatment. Consult a qualified health professional before starting any exercise program, especially if you have an injury, a medical condition, are pregnant, or haven't exercised in a while. Stop exercising and seek help if you feel pain, dizziness or shortness of breath.
You're responsible for exercising safely, using equipment properly, and training within your own limits. To the extent permitted by law, you use the Service at your own risk.
7. AI features
Some features (such as the coach chat and food-photo analysis) use Google's Gemini AI through an API key you provide. AI responses can be wrong, incomplete or inappropriate for your situation — treat them as suggestions, not instructions. Your use of Gemini is also subject to Google's terms. See the Privacy Policy for how this data flows.
8. Your account
Keep your sign-in details secure and let us know if you suspect unauthorised use. You're responsible for activity under your account. Please don't misuse the Service — for example, by trying to break or overload it, reverse-engineer it, resell access, or use it to harm others.
9. Your content
You own the data you create in MuscleUp (your workouts, logs and photos). You give us permission to store and process the parts that sync to your account only as needed to run the Service for you. Body photos stay on your device and are never uploaded to us.
10. Our content
The app, its design, exercise videos, images, text and software belong to MuscleUp or its licensors. Your subscription gives you a personal, non-transferable, non-exclusive licence to use them while your subscription is active.
11. Changes to the Service
We're constantly improving MuscleUp, so features may change. If we make a change that materially reduces what you're paying for, we'll let you know and you may cancel.
12. Ending your use
You can stop using the Service and cancel at any time. We may suspend or close accounts that seriously breach these Terms, with notice where reasonable. If we close your account without cause, we'll refund any prepaid, unused portion.
13. Liability
To the maximum extent permitted by law, the Service is provided "as is", and our total liability to you for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. We aren't liable for indirect or consequential losses. Nothing here excludes liability that cannot legally be excluded, such as liability for death or personal injury caused by negligence, or fraud.
14. Governing law
These Terms are governed by the laws of the State of Israel, and the competent courts in Israel have jurisdiction — without depriving you of the protection of mandatory consumer laws of the country where you live, or your right to bring a claim there. [To be confirmed by counsel.]
15. Changes to these Terms
If we update these Terms, we'll post the new version here and, for significant changes, notify you in advance. Continuing to use the Service after changes take effect means you accept them.
